General Terms and Conditions (GTC)
Introduction: Leasys S.p.A. German Branch (hereinafter: Leasys), located at Friedrich-
Lutzmann-Ring 1, 65428 Rüsselsheim am Main, sells used vehicles from lease returns
via the online platform Clickar S.r.l. (hereinafter: Clickar). Only registered business customers can access the used car market.
Participation Requirements: To participate in the Clickar platform, the buyer must accept Leasys' General Terms and Conditions (GTC). Acceptance is given by clicking the "Yes" button at the end of these terms.
Vehicle Data: Leasys does not know the condition of the used vehicles and assumes no responsibility for their quality or origin. The vehicle conditions are presented through photos and corresponding descriptions. All vehicles are appraised by experts to determine the market value. Leasys undertakes to provide the most accurate possible description based on these appraisals.
Note: The repair costs stated in the appraisals are for guidance only.
They may be higher or lower depending on the individual bidder's calculations. Minor damage such as scratches or dents might not be listed in the appraisal. Furthermore, hidden defects due to lack of maintenance, such as defective batteries or tires, may be present. Conversely, valuable features like leather seats or air conditioning might not be mentioned in the appraisal.
In all the above cases, the price will neither be increased nor reduced. The risks and opportunities lie with the bidder, unless there are serious defects that impair the vehicle's usability (e.g., serious damage to the engine or transmission) or significant errors in the appraisal (e.g., if a vehicle is described as a five-door but is actually only a three-door).
Conclusion of the purchase agreement: In the case of an auction: The purchase agreement is concluded at the end of the auction.
The purchase agreement is concluded with the highest bidder, i.e., with the person who submitted the highest bid and exceeded the minimum bid.
In the case of an auction with a Click&Buy option / Showcase: The purchase agreement is concluded as soon as the customer confirms the purchase by activating the function specifically provided for this purpose in the application ("Direct Purchase").
Reservations: Leasys assumes no responsibility for disruptions to the online platform or connection problems that prevent the sale or change the terms of sale.
Leasys sells vehicles via the Clickar platform while simultaneously offering them for sale via other sales channels. Leasys therefore reserves the right to withdraw a bid, even if the auction is already running or has been completed. The same applies to a Direct Purchase. In these cases, the highest bidder has no right to the conclusion of the purchase agreement and cannot claim damages.
No warranty/liability: The sale of vehicles via the Clickar platform is a commercial sale without warranty for defects. Complaints regarding the points listed under
"Vehicle Data" can only be submitted within ten days of receiving the collection authorization from Leasys. It is recommended that any defects or missing parts be confirmed at the vehicle collection appointment.
Invoicing: The invoice will be sent separately after confirmation of the purchase agreement. Payment is due immediately. The vehicle remains the property of Leasys until full payment is received.
Vehicle Collection: The vehicles must be collected by the buyer at their own expense.
After receipt of payment, Leasys will send the collection authorization and vehicle documents. Collection must take place within 10 days of receiving the authorization, by arrangement with the responsible dealer.
Transport: If Leasys uses a shipping company for transport, the transport costs will be invoiced separately and must be paid immediately. The stated rates apply to roadworthy vehicles and only within Germany. Costs for non-roadworthy vehicles must be requested separately.

Cooperation obligations under the Money Laundering Act (GwG): The Money Laundering Act (GwG)
obligates Leasys to fulfill due diligence obligations, including the identification and
verification of the data of its contractual partners (Know Your Customer principle).
The contractual partner must provide all necessary information and documents to fulfill these
obligations and declare whether the transaction is being carried out on behalf of a "beneficial owner" and provide their identity.
